General Terms and Conditions
GENERAL TERMS AND CONDITIONS
1. Scope and Applicability
These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all brands and products of Master of Time SA and to all orders placed with Master of Time SA (hereinafter referred to as “MoT SA”) as well as contracts concluded (hereinafter referred to as “Order”).
The GTC form an integral part of all contracts between the buyer and MoT SA. They apply regardless of whether the purchase is made online, by phone, via email, or in a physical store.
Deviating conditions of the buyer will not be recognized, unless MoT SA expressly agrees to them in writing.
2. Changes to the GTC
MoT SA reserves the right to change, supplement, or update the GTC at any time. Changes may be necessary to meet legal requirements, improve the offer, or adjust business practices.
The version of the terms and conditions (T&Cs) that is valid at the time of the order or the concluded contract is decisive. The customer will be informed of significant changes via email or through the website.
By placing a new order, the customer accepts the T&Cs that are valid at the time of the order in their current version.
3. Ordering Process and Conclusion of Contract
All products displayed online (websites, eBay, auction platforms, etc.) or in catalogs are non-binding offers from MoT SA.
By placing an order, the customer makes a binding offer to conclude a purchase contract. MoT SA confirms receipt of the order via email and reserves the right to accept or reject the order.
The purchase contract is concluded when MoT SA confirms the order in writing or ships the goods.
4. Prices and Payment Terms
All prices stated are in Swiss Francs (CHF) excluding applicable value-added tax, unless otherwise stated.
Shipping costs are calculated separately and clearly communicated before the order.
Payments must be made according to the payment terms specified at the time of the order. MoT SA accepts the following payment methods: credit card, postal transfer, TWINT, etc.
In the event of payment default, MoT SA reserves the right to cancel the order and charge reminder fees.
5. Delivery and Shipping
MoT SA ships orders within 2-3 working days after receipt of payment. The stated delivery times are non-binding guidelines.
The risk of loss or damage to the goods passes to the buyer upon shipment.
MoT SA is not responsible for delays caused by third parties (logistics partners, customs authorities, etc.).
In case of delivery delays, the buyer will be informed. If a delivery has not occurred 30 days after shipping, the buyer may withdraw from the contract.
6. Warranty and Guarantee
Quality Guarantee:MoT SA guarantees compliance with the highest quality standards for all products offered in the online shop or in physical stores. All products are subjected to quality control before shipping.
Warranty Period:Unless otherwise stated in the product details, the warranty period for all products is2 yearsfrom the date of purchase. This period applies to material and workmanship defects under normal use.
Scope of Warranty:The warranty covers defects that are due to faulty materials or workmanship. Excluded are:
- Wear from normal use
- Damage from improper handling or storage
- Damage from external influences (water, impacts, accidents, etc.)
- Defects resulting from modifications or repairs by third parties
- Scratches or cosmetic defects
Claiming Defects:Defects must be reported in writing within 14 days of receiving the product. The buyer has the option to exchange the defective product free of charge, have it repaired, or receive a refund.
Deviating Guarantees:For individual products, different warranty conditions may be specified in the online shop or in stores. These take precedence over the general provisions.
7. Right of withdrawal CH, LI and worldwide with Europe exception
According to Swiss legislation, we do not grant a general right of withdrawal for Switzerland and Liechtenstein. If a MoT SA product does not meet your expectations, please contact us. We will find a satisfactory solution for both parties together.
There is no right of withdrawal for MoT SA products worldwide, regardless of jurisdiction or applicable laws. The European area is an exception, for which separate provisions are set out in point 8.
8. Right of return and right of withdrawal for Europe
The buyer has the right to return products within 14 days of receipt without giving any reason, provided they are unused and in their original packaging.
The return shipping costs are to be borne by the buyer unless the return is due to a defect or an error by MoT SA.
After receiving and checking the returned goods, MoT SA will refund the purchase amount within 14 days to the original payment method.
9. Data protection and data security
MoT SA treats all personal data of the buyer confidentially and in accordance with applicable data protection regulations and the privacy policy.
Personal data is used exclusively for processing the order, communication, and marketing purposes.
10. Liability and limitation of liability
MoT SA is liable for damages caused by intent or gross negligence.
No liability is accepted for indirect damages, consequential damages, or lost profits.
Liability is limited to the purchase price of the respective product.
11. Intellectual Property
All content on the MoT SA website (texts, images, logos, design) is protected by copyright and trademark law.
Reproduction, distribution, or commercial use without explicit permission is prohibited.
12. Final Provisions
Applicable Law:The legal relationship between MoT SA and the customer is exclusively governed by substantive Swiss law.
Conflict of law provisions and the Vienna Sales Convention (CISG - United Nations Convention on Contracts for the International Sale of Goods) are excluded. The exclusive jurisdiction is CH-2500 Biel/Bienne / Canton of Bern.
Severability Clause:Should any provision of these terms and conditions be invalid, the remaining provisions shall remain valid.
Complete Agreement:These terms and conditions constitute the complete agreement between MoT SA and the buyer and replace all prior agreements.
